Terms of Use for Keystone.Jobs

These terms (together with the Privacy Policy) explain how Keystone Employment Group No.1 Limited operates www.keystone.jobs (our site), the ways that you are permitted to use our site, and the services available through our site.

Please read these terms of use carefully before you start to use our site. These terms of use are deemed accepted by you each time that you use or access our site. Users will be asked to confirm this upon registration. If you do not agree to these terms of use, please refrain from using our site.

1. ABOUT US & OUR SITE

Keystone.jobs is operated by Keystone Employment Group No.1 Limited (we, us and our shall be construed accordingly). We are registered in England and Wales under company number 13020864 and have our registered office at Sutton Vale Country Park, Dover, Kent, CT15 5DH.

We may revise these terms at any time by posting an updated version to this web page. You will be notified if any changes to these terms and asked for your agreement to them.

Our site is a recruitment website specialising operating as an “employment agency” within the meaning of the Conduct of Employment Agencies etc Regulations 2003. We enable employers to post job vacancies directly onto the site and contact prospective employees directly. Prospective employees (job seekers) are able to post their CVs and apply for the job vacancies available.

Our site is directed at businesses and individuals based within the United Kingdom. We make no claims or representations that our site may be lawfully viewed or accessed outside of the United Kingdom. If you access our site you do so at your own risk.

2. ACCESSING OUR SITE & AVAILABILITY

Access to our site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our site without notice. We do not accept liability for any errors, omissions, interruptions or delays, or for any ongoing responsibility to operate our site (or any particular part of our site), or to continue to provide the service offered on our site.

We restrict access to some parts of our site to employers and employees that are registered with us. To register you must select your account type (either Client or Candidate) and choose a username or password as part of our security procedures. You will then be able to upload details and begin advertising on the site.

You are responsible for all use of your username and password, and must keep them secret. This rule also applies to employers, although employers can create several logins for the same account and set different administration levels for each login.

We may disable any user account registration (including the related username and password) if, in our opinion, you fail to comply with these terms of use.

You understand and agree that you account is non-transferable and we will disable your account with immediate effect if you attempt to transfer your account. If your account is disabled as a breach of these terms we do not take any responsibility for lost data.

3. OUR SITE CHANGES REGULARLY

We aim to update our site regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time, and we are under no obligation to update such material.

4. RELIANCE ON INFORMATION POSTED

Whilst we make every effort to ensure that the information on this site is accurate and complete, most of the information is supplied to us by our users, and we are not able to check the accuracy or completeness of that information. We do not accept any liability arising from any inaccuracy or omission in the user generated information on our site or any liability in respect of information on this site supplied by you.

5. ADDITIONAL TERMS FOR EMPLOYER ACCOUNT USERS

Employers are solely responsible for their postings on our site. We have no authority to act on your behalf and we shall not be responsible for any employment decisions, for whatever reason, made by any user posting job vacancies on our site. We do not warrant the accuracy of information provided by prospective employees using our site, nor do we warrant their status to work in the UK – you must carry out the necessary checks yourselves./p>

The employer account function on our site is only to be used by organisations seeking employees for their own internal business purposes. Our site is not for use by employment agencies, employment businesses or recruitment specialists without our express written prior approval.

You understand and acknowledge that if you cancel your employer account or your employer account is terminated, all information uploaded to or saved on our site, including saved CVs and email mailing lists, will be marked as deleted and may be deleted from our databases. Information may continue to be available for some period of time because of delays in propagating such deletion through our web servers - you should contact us if you wish to check the availability of such data.

6. ADDITIONAL TERMS FOR PROSPECTIVE EMPLOYEES

Prospective employees are responsible for the accuracy of any information provided to employers. Terms of any future employment are to be agreed solely between employer and prospective employee. We do not check or warrant the accuracy of information provided by employers that use our site – you must satisfy yourself of the suitability of any organisation before accepting employment with it.

The employee account function on our site is only to be used by individuals seeking employment for themselves. Our site is not to be used by employment agencies, employment businesses or recruitment specialists without our express written approval. (Agencies can use Keystone.jobs, only if specified when registering)

You understand and acknowledge that if you cancel your account with us or your account is terminated, all information uploaded to or saved on our site (including your CV) will be marked as deleted and may be deleted from our databases. Information may continue to be available for some period of time because of delays in propagating such deletion through our web servers - you should contact us if you wish to check the availability of such data.

By agreeing to these terms, you consent to the details that you upload to our site being made available to employers that wish to find out information about you. We are not responsible for contact between yourself and any employer that has used our site. We are also not able to prevent employers from contacting you after you have deleted your account, although your details will be removed from our site in the manner outlined above.

If you do not logon to your account for a continuous period of 52 weeks, your account may be removed and uploaded details deleted.

7. INFORMATION SUBMITTED BY YOU

We will use the information supplied by you (including, without limitation, sensitive personal data) to aid the recruitment process and associated administrative functions. This involves us, for example, processing and storing information (including, without limitation, sensitive personal data) and passing or making it available online. For a prospective employee this means that your CV (excluding contact details fields) will be publically available to anyone that views our site, and that your contact details will be sent to employers that use our site on request. As an employer this means that a prospective employee will be able to view your job posting and that they will be able to contact you through our site.

To help run our site we use third parties to process information for us. We may also collect and aggregate data from the information supplied by you and others to help us to understand the use of our site. We may share this aggregate information with selected third parties, without disclosing individual names or identifying information.

The information uploaded to our site may be used and processed by us (and others approved by us) in the United Kingdom or any other country inside of the European Economic Area. We explain more about how we use and process information in our Privacy Policy.

8. ACCEPTABLE USE

You agree to be solely and wholly responsible for the information and other material that you upload to our site or transmit through our site (including any claims, damages and expenses that we may suffer in connection with any claim related to such information or material.

You are responsible for ensuring that all information supplied by you is true, accurate, up-to-date and not misleading or likely to mislead or deceive. The information that you supply must also not be discriminatory, obscene, offensive, defamatory or otherwise illegal, unlawful or in breach of any applicable legislation, regulations, guidelines or codes of practice.

We reserve the right to remove any information supplied by you from the website at our sole discretion, at any time and for any reason without being required to give any explanation.

The job posting, CV database and other features of our site may be used only by prospective employees seeking employment and/or career information and by employers seeking employees.

Further rules on the content of job postings are set out below.

9. JOB POSTINGS

Employers are able to post job vacancies for prospective employees to view. A short description of the company is also required to be included with each new job posting. Employees will also make their details available through job postings. A job posting can be accessed at anytime and marked for amendment or deletion by the user that posted it. A number or rules on the content of each job posting are set out below:

A job posting may not contain:

9.1  any contact details, other than in the specific contact details fields (for example, e-mail addresses, and telephone numbers must only be set out in the e-mail address and telephone number fields);

9.2  any hyperlinks, other than those specifically authorised by Keystone.jobs; and misleading, unreadable, or "hidden" keywords, repeated keywords or keywords that are irrelevant to the job opportunity being presented, as determined in our reasonable discretion.

You must not use your job posting to:

9.3  post any business opportunity that pays commission only unless the posting clearly states that the available job pays commission only and clearly describes the product or service that the job seeker would be selling;

9.4  promote any opportunity that does not represent bona fide employment;

9.5  post jobs on our site for modeling, acting, talent or entertainment agencies or talent scouting positions; (Agencies can use Keystone.jobs, only if specified when registering)

9.6  advertise sexual services or seek employees for jobs of a sexual nature;

9.7  request the use of human body parts or the donation of human parts, including, without limitation, reproductive services such as egg donation and surrogacy;

9.8  endorse a particular political party, political agenda, political position or issue;

9.9  promote a particular religion; and

9.10  except where allowed by applicable law, post jobs which require the applicant to provide information relating to his/her (i) racial or ethnic origin (ii) political beliefs (iii) philosophical or religious beliefs (iv) membership of a trade union (v) physical or mental health (vi) sexual life (vii) the commission of criminal offences or proceedings or (viii) age.

We reserve the right to remove any job posting or content from our site which we consider (in the reasonable exercise of our discretion) does not comply with the above terms, or if any content is posted that we believe is not in the best interest of our site. In these circumstances you will not be entitled to a refund of any payment made by you.

If at any time during your use of our site, you make a misrepresentation of fact to us or otherwise mislead us in regard to the nature of your activities, we may terminate your use of our site without being required to refund any payment made by you.

10. UPLOADING MATERIAL TO OUR SITE

Any material you upload to our site will be considered non-confidential and non-proprietary, and we have the right to use, copy, distribute and disclose to third parties any such material for the purpose of promoting our site and services. We also have the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy.

We will not be responsible, or liable to any third party, for the content or accuracy of any materials posted by you or any other user of our site.

You must not:

10.1  post any CV or apply for any job on behalf of another party on our site;

10.2  post more than one copy of the same CV to public at any one time on our site;

10.3  access data not intended for you or logging into a server or account which you are not authorized to access;

10.4  post or submit to our site any incomplete, false or inaccurate biographical information or information which is not your own;

10.5  delete or alter any material posted by any other person or entity;

10.6  harass, incite harassment or advocate harassment of any group, company, or individual; or

10.7  post any CV which is not a genuine CV and which attempts to advertise or promote products or services.

11. VIRUSES, HACKING AND OTHER OFFENCES

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site.

You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any material posted on it, or on any website linked to it.

12. LINKS TO OTHER SITES

Our site will offer you automatic links to other sites which we hope will be of interest to you. We do not accept any responsibility for those sites, the owners of which do not necessarily have any connection (commercial or otherwise) with us. Using automatic links to gain access to such sites is entirely at your own risk.

13. LINKING TO OUR SITE

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link from any website that is not owned by you.

Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page. We reserve the right to withdraw linking permission without notice. If you wish to make any use of material on our site other than that set out above, please address your request to info@Keystone.jobs.

14. INTELLECTUAL PROPERTY RIGHTS

We are the owner or the licensee of all intellectual property rights in our site such as but not limited to trade names, text, graphics, images, information, software and other content. Those works are protected by copyright, software, trademark and other laws. Unauthorised use of our site may violate these laws, and is strictly prohibited. All such rights are reserved.

You must not use any part of the materials on our site for commercial purposes without obtaining permission to do so from us or our licensors.

15. PAYMENT

Our site is free for prospective employees to use. Employers are subject to charges set out in the employer account section of our site. The remainder of this section is only relevant to employers.

Payment by employers for the services available on the site is made using credits that you can purchase from the employer account pages. The payment for credits is non-refundable – we will only issue a refund if we terminate your account in circumstances where you have not breached these terms. One credit entitles you to view the contact details of one employee user of our site - it is free to see the other details of a CV and also free to place adverts.

Each time you make a request for the contact details of a prospective employee, your request will be submitted to our accounts department who will ensure that you hold enough credits to access the details. Once the credits have been deducted from your account, the requested details will be sent to you.

Credits are single use and not transferrable across accounts or users. Once prospective employee’s contact details have been sent by us, a refund cannot be requested.

Prospective employee details will not be forwarded if there are not enough cleared funds in your account to generate a credit. You will normally automatically receive an email from our accounts department if your credits are low.

VAT will be charged at the current rate. If the VAT rate changes, this will be applied to the total costs of services.

16. OUR LIABILITY

We do not act as agent for either employer or employee users and do not accept liability for any act or omission of either type of user. To the extent permitted bylaw, we, expressly exclude:

16.1  All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity relating to our site.

16.2  Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our site or in connection with the use, inability to use, or results of the use of our site, any websites linked to it and any materials posted on it, including but not limited to:

16.2.1  loss of income or revenue;

16.2.2  loss of business;

16.2.3  loss of profits or contracts;

16.2.4  loss of anticipated savings;

16.2.5  loss, destruction or corruption of data;

16.2.6  loss of goodwill;

16.2.7  lost recruitment opportunity;

16.2.8  lost employment opportunity;

16.2.9  wasted expenditure; or

16.2.10  any breach of your rights under current employment legislation.

whether arising in contract, tort (including negligence) or otherwise.

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation, nor any other liability which cannot be excluded or limited under applicable law.

As we provide a free service to employee users, our maximum aggregate liability to an employee user for all matters arising out of or in relation to our site will be limited to £50. Our maximum aggregate liability to an employer user for all matters arising out of or in relation to our site will be limited to £50 or (if greater) the total amount spent by that user in the 6 months preceding the circumstances giving rise to any claim.

17. JURISDICTION AND APPLICABLE LAW

These terms of use and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England.

If any provision of these terms are found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these terms, which shall remain in full force and effect. Our failure to enforce any term of these Terms shall not be deemed as a waiver of such term or otherwise affect our ability to enforce such term at any point inthe future.

18. CLOSURE OF YOUR ACCOUNT BY US

We may terminate your registration and/or deny you access to the site or any part of it (including any services, goods or information available on or through the site) at any time in our absolute discretion and without notification or refund if we consider it to be reasonable and in the best interests of our site.

If your account has been disabled by us you are not permitted to attempt to re-register or use a different account on our site.
